Article 1: Purpose

These general terms and conditions of sale (T&Cs) apply without restriction or reservation to all orders from :

  • Blood sampling and biological analysis kits (hereinafter referred to as the " Kits ")
  • Artificial intelligence-powered well-being support services (hereinafter referred to as the "Services")
  • Premium subscriptions (hereinafter referred to as the " Subscription ")

spent with the company Ainoha (hereinafter referred to as the "Client").

These Terms and Conditions, together with the order form, constitute an inseparable contractual agreement. In the event of any conflict, the provisions of the Terms and Conditions shall prevail.

Article 2: Services

2.1 Type of Service

Ainoha's services focus on well-being and health prevention. They do not constitute a medical act, a diagnosis or a medical prescription.

2.2 Composition of the offer23

  • Collection Kit: Biomarker Analysis (Vitamin D, Omega-3)
  • Personalized report: Interpretation by artificial intelligence
  • Recommendations: Suggestions for concrete actions for well-being and supplementation
  • Premium subscription: Personalized tracking and advanced features

2.3 Important Disclaimer

The results and recommendations do not replace a medical consultation. If you have any concerns about your health, consult a healthcare professional.

Article 3: Order and Acceptance

3.1 Ordering process

All orders placed via the ainoha.fr website or the mobile application imply full acceptance of these GTC in the version in force on the order date.

3.2 Order confirmation

The sale is only final after receipt of payment.

3.3 Customer Information

The Customer agrees to provide accurate and complete information, especially in the health questionnaires, as this is crucial for the quality of the recommendations.

Article 4: Right to complain

4.1 Legal deadline

In accordance with the Consumer Code, the Customer has a period of 14 days from the day after receiving the Kit or the day after payment of the Subscription to exercise their right of withdrawal.

4.2 Exceptions

The right of withdrawal cannot be exercised for:

  • Kits used (personalized health products)

4.3 Terms and Conditions

To cancel emailsav@ainoha.fr. Refunds will be processed within 14 days of the cancellation request.

Article 5: Price and payment

5.1 Price

Prices are listed in euros, inclusive of all taxes. Ainoha reserves the right to modify its prices, with new prices applicable to subsequent orders.

5.2 Payment Terms

  • Secure payment: Stripe, Apple Pay, Google Pay
  • Subscription: Monthly or annual direct debit

5.3 Default of payment

In the event of non-payment, Ainoha reserves the right to suspend the Services and terminate the Subscription.

Article 6: Delivery

6.1 Delivery times

Kits are dispatched within 48-72 business hours. Delivery times are estimates.

6.2 Terms and Conditions

Delivery to the address provided by the Customer. The Customer is responsible for verifying the package upon receipt.

6.3 Delivery Delay

In the event of a delay exceeding 14 days, the Customer may cancel their order and receive a full refund.

Article 7: Using the kit

7.1 Instructions

The Customer agrees to strictly follow the instructions provided with the Kit.

7.2 Storage Conditions

The Kit should be stored according to the indicated conditions (temperature, humidity).

7.3 Shipping back the Sample

The sample must be returned within the indicated timeframe to ensure the quality of the analysis.

Article 8: Results and reports

8.1 Delivery Time

Results are available within 7 to 15 working days after we receive the sample at the address provided on the return envelope.

8.2 Accessing Results

Results are accessible via the mobile app or the website in the secure Customer Area.

Article 9: Returns and non-conformities

9.1 Claim period

Any complaint must be made within 5 business days of receiving the analysis report at sav@ainoha.fr.

9.2 Defective kit

  • Technical Defect in the Kit: Free Replacement
  • Limit: Maximum 2 replacements per order

9.3 Analysis error

In the event of a confirmed technical anomaly at the partner laboratory, a new analysis will be provided free of charge.

Article 10: Warranties

10.1 Kit Warranty

  • Compliance: Date indicated on the kit
  • Conditions: Follow the storage and use instructions provided on the kit.
  • Exclusions: Misuse, improper storage, exceeding deadlines

10.2 Digital Services Warranty

  • Availability: 99% of the time (excluding scheduled maintenance)
  • Security: Hosted on approved HDS servers

Article 11: Responsibilities

11.1 Ainoha's Liability

Ainoha acts as a wellness service provider. Its liability is limited to direct damages resulting from proven fault, excluding any indirect damages.

11.2 Limitations of Liability

  • Maximum amount: Total price paid by the Customer
  • Exclusions: Misuse, failure to follow instructions, decisions made based on the recommendations

11.3 Customer Responsibility

The Customer is responsible for the accuracy of the information provided and for the proper use of the Services.

Article 12: Premium Subscription

12.1 Subscription

The Subscription is for a period of one month to one year, automatically renewable.

12.2 Termination of Contract

The Customer may cancel their Subscription at any time from their Customer account. Termination takes effect at the end of the current period.

12.3 Suspension

Ainoha may suspend the Subscription in the event of non-payment or breach of these T&Cs.

Article 13: Personal data

13.1 Data processing

Ainoha handles personal data, including health data, in accordance with the GDPR and its Privacy Policy available on ainoha.co.uk.

13.2 Secure Hosting

The data is hosted on HDS (Health Data Hosting) servers approved in Europe.

13.3 Partner Laboratory

The partner laboratory receives only anonymized data and destroys the samples after analysis.

13.4 Shelf life

  • Personal data: 5 years maximum
  • Health data: 5 years (early deletion on request)

13.5 Client Rights

Customers have the right to access, rectify, delete, transfer, and object to the use of their personal data. For inquiries, contact:  dpo@ainoha.fr

Article 14: Confidentiality

Ainoha undertakes to keep all documents, data and information transmitted by the Customer strictly confidential. This obligation extends to all employees, collaborators and partners.

Article 15: Intellectual property

Ainoha retains all intellectual property rights to its services, artificial intelligence algorithms, applications, and documentation, which may not be used without express authorization.

Article 16: Subcontracting

Ainoha may entrust service providers (laboratories, hosts, carriers) with the performance of certain services. Ainoha remains responsible for the proper performance of its obligations.

Article 17: Force Majeure

Ainoha may not be held liable for any delay or non-performance due to a case of force majeure as defined by French case law.

Article 18: Duration and Termination

These General Terms and Conditions become effective on the order date and remain valid for the duration necessary to perform the services.

Ainoha may terminate the contract in the event of a serious breach of the Client's obligations.

Article 19: Modification of the T&Cs

Ainoha reserves the right to modify these T&Cs. The new terms and conditions shall apply to orders placed after they have been published online.

ARTICLE 20: Settlement of disputes

20.1 Applicable law

The relationship between the parties is governed by French law.

20.2 Amicable settlement

In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action.

20.3 Mediation

In the event that an amicable resolution cannot be reached, the Customer may refer the matter to the consumer mediator: www.economie.gouv.fr/mediation-conso

20.4 Jurisdiction

In the absence of an amicable agreement, the courts of Grenoble shall have sole jurisdiction.
